In order to provide implementation of the decree of the President of the Republic of Azerbaijan No. 668 of 29 January 2002 on application of the Law of the Republic of Azerbaijan “On public procurements” within 15 days:

1. To charge Ministry of Justice of the Republic of Azerbaijan together with State agency on procurement to prepare and submit to the Cabinet of Ministers of the Republic of Azerbaijan:

proposals on bringing of current legislative acts in accordance with the Law of the Republic of Azerbaijan “On public procurements”;

proposals on bringing of regulations of the Cabinet of Ministers in accordance with this Law;

draft legislative act setting types of responsibility for violation of the Law of the Republic of Azerbaijan “On public procurements”;

to provide bringing of regulations of respective central executive authorities in accordance with this Law and inform the Cabinet of Ministers of the Republic of Azerbaijan about it.

2. To charge the State agency of the Republic of Azerbaijan on procurement upon agreement with Ministry of Finances, Ministry of Justice, Ministry of Economic Development to prepare and submit to the Cabinet of Ministers of the Republic of Azerbaijan:

proposals with regard to amount of allocable parts in accordance with 11.5 of the Law of the Republic of Azerbaijan “On public procurements”;

draft volume and application procedure of benefit in accordance with article 36.10 of this Law;

draft sample of final protocol of tender commission in accordance with article 37.6 of this Law;

draft sample of procurement contract on goods (works and services) in accordance with article 40.11 of this Law;

proposals on application of preferential correction in favor of local service providers at assessment and comparison of service proposals by procurement agency in accordance with article 44.2 of this Law;

draft calculation method of impact of changes in prices of goods (works and services) to procurement contract in accordance with article 51.2 of this Law;

draft of new Provisions on State agency of the Republic of Azerbaijan on procurement due to making changes of its functions.

3. To charge law division of the clerical department of the Cabinet of Ministers of the Republic of Azerbaijan with supervision over clause 1 and economic and financial-credit department with supervision over clause 2 of this resolution.
