In connection with application of the Law of the Republic of Azerbaijan “On public procurements” I hereby resolve:

To amend “Rules on privatization of state enterprises under individual projects” approved by the Law of the President of the Republic of Azerbaijan under decree No. 432 of 23 December 2000 as follows:

1.1. To replace words “These rules on privatization of state property” and “Laws of the Republic of Azerbaijan “On tender” in article 1.1 of the Rules with words “These rules on privatization of state property” and “other laws of the Republic of Azerbaijan”.

1.2. To replace words “tender” and “of tender” in second paragraph of article 1.2, article 2.3, sixth and seventh paragraphs of article 3.4, in the name of section 4, articles 4.1 and 4.2 of the same section, as well as in article 5.2 of the Rules with words “competition” and “of competition”.

1.3. To give article 3.2 of the Rules as follows:

“3.2. Selection of financial consultant (expect cases when consultant’s service fee is paid by person, which won tender) shall be carried out by the Ministry of Economic Development in accordance with legislation of the Republic of Azerbaijan on public procurements”.

1.4. To exclude article 4.3 of the Rules.

2. To amend the “Provisions on the Ministry of Economic Development of the Republic of Azerbaijan” approved by decree of the President of the Republic of Azerbaijan No. 495 of 11 June 2001 as follows:

2.1. To replace word “tenders” in sub-article 10.64 of the Provisions with word “competitions”.

2.2. To give article 10.72 of the Provisions as follows:

“10.72. attract entrepreneurship entities for implementation of state orders in accordance with legislation on public procurements.”

To exclude word “(tender)” from article 4 of “the Rules of giving of municipality orders” approved by decree of the President of the Republic of Azerbaijan No. 529 of 4 July 2001.

4. This decree takes effect from the day of its signing.
