Milli Mejlis of the Republic of Azerbaijan hereby resolves:

I. To exclude word “tender” from second part of article 6 and word “of tender” from first part of article 16 of the Law of the Republic of Azerbaijan “On investment activity” (Information of Supreme Council of the Republic of Azerbaijan, 1995, No. 17-18, article 275; Collection of Legislation of the Republic of Azerbaijan, 2001, No. 6, article 360; No. 11, article 683; No. 12, article 736).

II. To amend the Law of the Republic of Azerbaijan “On power engineering” (Collection of legislation of the Republic of Azerbaijan, 1998, No. 6, article 363; 2001, No. 11, article 696) as follows:

1) to replace word “tender (competition)” in second part of article 5 with word “competition”.

2) to replace word “without tender” (without competition) in third part of article 5 with word “without competition”

3) to exclude words “in accordance with the Law of the Republic of Azerbaijan “On tender” from first part of article 22.

III. To amend the Law of the Republic of Azerbaijan “On architect activity” (Collection of Legislation of the Republic of Azerbaijan, 1998, No. 6, article 374) as follows”:

1. to replace word “of tender” in fifth paragraph of article 7 with word “of competition”;

2. to replace word “in tender” in third part of article 11 with word “in competition”

IV. To give second point of article 13 of the Law of the Republic of Azerbaijan “On state assistance to small entrepreneurship” (Collection of legislation of the Republic of Azerbaijan, 1999, No. 8, article 469; 2001, No. 12, article 736) as follows:

“2. participation of small entrepreneurship entities in performance of orders on production of goods, performance of works and provision of services for state needs shall be carried out in accordance with legislation of the Republic of Azerbaijan on public procurements”.

V. To give tenth paragraph of second part of article 3 of the Law of the Republic of Azerbaijan “On publication activity” (Collection of legislation of the Republic of Azerbaijan, 2000, No. 8, article 581) as follows:

“provision of publication of state-ordered textbooks through conducting of public procurements between publication houses in accordance with legislation of the Republic of Azerbaijan”.

VI. To add new article 404.1 to the Civil Code of the Republic of Azerbaijan (Collection of legislation of the Republic of Azerbaijan, 2000, No. 4, article 250) as follows:

“Article 404.1 Public procurement contract

Relations with regard to public procurements shall be governed under legislation of the Republic of Azerbaijan on public procurements.”
