In order to provide implementation of paragraph 6 of article 1 of the Decree of the President of the Republic of Azerbaijan on application of the Law of the Republic of Azerbaijan “On public procurements” No. 668 of 29 January 2002, the Cabinet of Ministers of the Republic of Azerbaijan HEREBY RESOLVES:

1. To approve “sample of final protocol of tender commission about tender results” (attached).

2. Decision of the Cabinet of Ministers of the Republic of Azerbaijan “On sample of protocol of tender commission about tender result” and “On approval of sample of final contract” No. 87 of 12 May 2000 shall be considered null and void.

3. This decision takes effect from the day of its signing.

NOTE:

1. Copy of final protocol of tender commission about tender results shall be officially submitted to the State Agency on procurement within 3 (three) banking days after its signing.

2. Final protocol of tender commission shall give a basis to procurement agency to enter into procurement contract with consignor (contractor), which took first place as a result of assessment and comparison of tender proposals.

3. Failure of tender winner to sign procurement contract or provide guarantee for performance of the contract within terms as provided by legislation, shall be considered as its inability to perform its obligations and shall lead to non-returning of guarantee for tender proposal. If there are such cases, additional information shall be given to State Agency on procurement.
