On approval of Rules “On conducting of procurement of goods (works and services) through open tender in case of their supposed price exceeds established minimal amount”, “On possibility for procurement agencies to use request for quotations for procurement of goods (works and services) having current market in case their supposed price is less than established minimal price” and “On publication of notice about procurement also in internationally widely distributed organs of press and Internet except cases when only local consignors (contractors) participate in procurements or when total value of procured services does not exceed established amount”.

In order to implement articles 17.1, 20.1 and 41.2 of the Law of the Republic of Azerbaijan “On public procurements” and clause 2 of the Decree of the President of the Republic of Azerbaijan “On application of the Law of the Republic of Azerbaijan “On public procurements” No. 668 of 29 January 2002, I HEREBY DECREE:

1. To approve Rules “On conducting of procurement of goods (works and services) through open tender in case of their supposed price exceeds established minimal amount”, “On possibility for procurement agencies to use request for quotations for procurement of goods (works and services) having current market in case their supposed price is less than established minimal price” and “On publication of notice about procurement also in internationally widely distributed organs of press and Internet except cases when only local consignors (contractors) participate in procurements or when total value of procured services does not exceed established amount”.

2. Head Administration on Tax Policy and Incomes and Head Administration on Finances of National Economy shall ensure that information relating to this decree is provided to organizations funded from the budget.

These Rules have been prepared by the Ministry of Finance of the Republic of Azerbaijan under Law of the Republic of Azerbaijan “On public procurements” and Decree of the President of the Republic of Azerbaijan “On application of the Law of the Republic of Azerbaijan “On public procurements” No. 668 dated 29 January 2002.

2. Rules “On conducting of procurement of goods (works and services) through open tender in case of their supposed price exceeds established minimal amount”, “On possibility for procurement agencies to use request for quotations for procurement of goods (works and services) having current market in case their supposed price is less than established minimal price” and “On publication of notice about procurement also in internationally widely distributed organs of press and Internet except cases when only local consignors (contractors) participate in procurements or when total value of procured services does not exceed established amount” at conducting of public procurements determine acts of participants of public procurements.

3. Minimal amount of supposed price of goods (works and services) when goods (works and services) are procured through open tender shall be set as 250.0 million manat.

4. For procurement of goods (works and services), which have current market and which supposed price is less than amount set in article 3 of these Rules, procurement agency may use request for quotations.

Minimal limit of amount for request for quotation shall be set as amount of 100 times of monthly nontaxable amount (10.0 million manat).

5. Except cases when only local consignors (contractors) participate in procurement or when total amount of procured services is not more than 50.0 million manat, notice shall be published in internationally widely distributed organ of press and in Internet.
