Along with familiarization with normative-legal documents, regulating public procurement in Azerbaijan Republic, information about public procurement carried out in the republic, their results, currency rates, organization of seminars, trainings and courses to improve qualification level of specialists involved in public procurement as well as information about articles published with respect to international and local experience can be obtained on this web-site as well.

State Agency on procurement was established under Decree of the President of Azerbaijan Republic No.583 dated 16 May 1997 to carry out state policy in field of procurement of goods (works and services) at the expense of state funds and duties of this Agency were determined by the Charter approved by Decree of the President of Azerbaijan Republic No.855 dated 20 February 2003 as per requirements of article 4 of the Law “On public procurements”. According to Charter, State Agency on procurement was charged with the following: establishment and improvement of normative-legal base, regulating public procurement in Azerbaijan Republic, ensuring of legality of procurement of goods (works and services) at the expense of state funds on the basis of tender and control of implementation of agreements, carrying out of measurements as provided for by legislation to improve qualification level of specialists of procurement organizations in field of public procurement, creation of information base in field of public procurement, implementation of other duties determined by legislation of Azerbaijan Republic.

First normative document, regulating public procurement in Azerbaijan Republic – Provisions “On procurement of goods (works and services) by budget organizations” was approved by Decree of the President of Azerbaijan Republic No.524 dated 19 December 1996; later on 11 February 1997, the Law of Azerbaijan Republic “On tender” was passed and on 7 April 1997, Decree of the President of Azerbaijan Republic on application of the Law of Azerbaijan Republic “On tender” was signed.

During application of indicated documents, State Agency on procurement having studied experience gained in this field and taking into account current documents of a number of European Union countries on public procurement, recommendations of the World Bank, requirements of provisions of International Trading Organization on public procurement, has worked out the draft new law “On public procurement”; this draft law was passed by Milli Mejlis on 27 December 2001 and came into effect under Decree of the President of Azerbaijan Republic No.668 dated 29 January 2002 on application of the Law “On public procurement”.

According to Law, all public procurement at the amount of AZM250 (two hundred and fifty) million and more are carried out through open tender. If proposed price of goods (works and services) is less than the amount of AZM250 (two hundred and fifty) million, procurement organization uses any procurement method.

If proposed price of tender subject is more than AZM5 billion and AZM1,5 in organizations funded from the budget or equivalent amount in free convertible currency, representatives of the Ministry of Finance, Ministry of Economic Development of Azerbaijan Republic and representatives of respective central executive authorities relating to the tender subject are included to the composition of tender commission.

Any resident or nonresident legal and physical persons or association of legal persons irrespective of state belonging can participate as tenderer in procurement procedures carried out in Azerbaijan Republic. Exceptions shall be stated in normative-legal documents, regulating public procurement in accordance with article 8.1 of the Law “On public procurement”.

For the purpose of implementation of assignments arising from Decree of the President of Azerbaijan Republic No.668 dated 29 January 2002 on application of the Law “On public procurement”, State Agency on procurement has produced documents ensuring implementation of the Law “On public procurement” and these documents were approved by the Cabinet of Ministers. Seminars “public procurement” are regularly held for specialists of the ministries, committees, administrations and organizations as well as for specialists of departments of education, public health, culture of cities and regions of the republic, local executive authorities, municipalities to improve qualification level of specialists of procurement organizations involved in public procurement. In order to provide wide involvement of small and middle entrepreneurs carrying out activity in Azerbaijan Republic in public procurement, seminars are held for representatives of such companies.
